The shooting of a man inside a Birmingham motorcycle club earlier this week has been ruled justifiable and no criminal charges will be filed.
David Franklin Lee, 37, was shot to death Monday. The shooting happened at 2:06 a.m. at Showstoppers Motorcycle Club on Coosa Street.
Authorities said some kind of argument happened which led to a fight and then gunfire. Sgt. Johnny Williams said Lee was found unresponsive inside the club.
Lee was pronounced dead on the scene at 2:19 a.m. Williams said the preliminary investigation reveals that Lee was involved in a verbal altercation when he was shot. Authorities have not identified the person who fired the deadly shots.
Investigators presented their evidence to the Jefferson County District Attorney’s Office for review. “The Jefferson County District Attorney’s office ruled the actions of the subject involved were justified as defense. This investigation is reclassified as Justified Death,’’ Williams said in a press release.
Lee was one of five people killed so far this year in homicides in Birmingham. The definition of homicide is the killing of one human being by another. Not all homicides are crimes, however, and police departments only submit criminal homicides to the FBI for its annual report. This is the first homicide in 2020 deemed justifiable.
The city ended 2019 with 106 homicides, 12 of which were deemed justifiable and therefore are not included in the city’s year-end numbers.
